MEMBERSHIP AGREEMENT

Article 1 - PARTIES

This contract is established with one part being ANTEPLİ BAKLAVA located at the address of Gazimuhtar Paşa Bulv. No:31, 27090 Şehitkamil/Gaziantep (hereinafter referred to as "ANTEPLİ BAKLAVA") and the other part being the person who is a member or will become a member of the website 'https://www.anteplibaklava.com.tr' (hereinafter referred to as "Website"), owned by ANTEPLİ BAKLAVA. This agreement is created to define the rights and obligations of the parties and set the terms for the use of the services, applications, and content provided on the Website.

Article 2 - DEFINITIONS

The definitions of the terms used in this agreement are as follows:
"Website": The site formed by the domain https://www.anteplibaklava.com.tr and its related subdomains,
"User": Any real or legal person who accesses the website online,
"Member": Real or legal persons who benefit from the services provided on the Website under the conditions mentioned in this agreement,
"Membership": The process completed by filling out the membership form from the relevant section of the "System", confirming the accuracy of the provided information, and finalizing the registration. Without completing this process, the person cannot obtain the rights and privileges of being a "Member".

Article 3 - SERVICES PROVIDED BY ANTEPLİ BAKLAVA

- ANTEPLİ BAKLAVA will provide the following services to the Member who approves this agreement through the Website:
- Sharing information, announcements, campaigns, and content related to ANTEPLİ BAKLAVA’s activities,
- Sharing updated information about ANTEPLİ BAKLAVA's products and services, news, projects, campaigns, announcements, and publications about significant days and weeks (Images, Documents, etc.),
- Sending e-newsletters to the Member's provided email address about announcements, campaigns, and changes,
- Conducting surveys to measure the Member’s satisfaction with products sold by ANTEPLİ BAKLAVA, and to gather opinions on quality and taste,
- Completing the membership registration process for users, ensuring their personal information (name, surname, email, address, and mobile phone) is collected and securely stored,
- Allowing the Member to purchase ANTEPLİ BAKLAVA's products from the Website.

Article 4 - WEBSITE MEMBERSHIP SYSTEM

When the User wants to become a member of the Website, they are required to fill out the Membership Form with accurate information and agree to comply with the terms outlined in the Membership Agreement. There is a checkbox, "I agree to the Membership Agreement", in the form. Based on the User's decision, they click on the " Continue" button. By clicking this button, the User will have accepted the conditions of the Agreement. Alternatively, by clicking " Register with Facebook," if the User registers via the "Facebook Social Platform," they will still be deemed to have accepted the Membership Agreement.

The Member will have a "Username/Email" and a "Password" to perform certain actions on the Website.

"Username" is unique to the Member, and no two Members will have the same "Username." "Password" is known only to the user who created it. The user can change the password at any time. The selection and protection of the password are the responsibility of the user. ANTEPLİ BAKLAVA is not responsible for any issues or mistakes caused by user errors related to the password. A user who forgets or loses their password can reset it by completing the necessary security steps. After successfully completing the security steps, the Member can set a new password, which will be valid whenever they log in to the Website.

Article 5 - MEMBER'S OBLIGATIONS

- The Member is responsible for the accuracy of the information provided in the ANTEPLİ BAKLAVA Website Membership Form. Any errors or omissions that cause damage will be the Member’s responsibility, and membership may be terminated in such cases,
- The Member is aware that the intellectual property rights of the services provided on the Website belong to ANTEPLİ BAKLAVA or the persons who have granted rights to ANTEPLİ BAKLAVA, and any violation of these rights will result in legal and penal liability,
- The Member is responsible for their personal opinions, thoughts, and statements made on the Website, and ANTEPLİ BAKLAVA is not responsible for any comments made by the Member,
- The Member cannot hold or use any software or material that could harm the Website or cause conflicts with ANTEPLİ BAKLAVA’s other websites. If any legal issue arises, the Member will take full responsibility,
- ANTEPLİ BAKLAVA is not responsible for any issues with products due to incorrect addresses, delay in shipping, or damages to perishable, breakable, or crushable goods,
- The Member agrees to compensate all material and moral damages caused by their non-compliance with the terms of this agreement,
- The Member is aware that ANTEPLİ BAKLAVA is not responsible for problems arising from unauthorized access to their data by third parties,
- The Member agrees not to send threatening, immoral, discriminatory, or illegal comments, in violation of Turkish laws or any other country’s laws,
- Comments posted on the Website must adhere to general ethics, decency, and legal standards,
- The Member agrees not to harass or threaten other Members or users,
- The Member agrees not to interfere with the ability of other Members or users to use the services,
- All information and data collected through the use of the ANTEPLİ BAKLAVA system is done with the user’s consent, and the Member is responsible for any issues such as computer problems, breakdowns, or data loss caused by using the system,
- The Member agrees not to use ANTEPLİ BAKLAVA's systems for commercial or advertising purposes without permission, and ANTEPLİ BAKLAVA has the right to monitor the system and take appropriate actions if any violations occur,
- The Member agrees not to share any data that is illegal or forbidden by law and not to distribute chain mail, software viruses, or unauthorized emails,
- The Member is personally responsible for any actions taken with their "Username" and acknowledges that even if they deactivate their membership unilaterally, they are still responsible for all actions taken during their membership period,
- The Member agrees to have read, accepted, and committed to all the conditions outlined in this Agreement.

Article 6 - RIGHTS AND AUTHORITIES GRANTED TO ANTEPLİ BAKLAVA

ANTEPLİ BAKLAVA has the right to suspend or terminate the operation of the system at any time. In such cases, ANTEPLİ BAKLAVA will not be liable to Members or third parties.

ANTEPLİ BAKLAVA is not responsible for any damages caused by technical failures in the Website's systems. ANTEPLİ BAKLAVA does not guarantee that the system will always be operational, secure, and error-free, nor that the results obtained from the system will always be accurate and reliable. ANTEPLİ BAKLAVA reserves the right to stop communication, publication, or data transfer at any time, and has the authority to delete messages or terminate memberships if necessary.

Article 7 - MEMBER DATA, E-NEWSLETTER, AND PRIVACY

ANTEPLİ BAKLAVA requests some personal data (such as Name, Address, National ID/Tax No, Email, etc.) from Users and Members during the membership process and while using the Website. This information is kept confidential and used to provide better and more reliable services, confirm orders, send commercial electronic communications (news, campaigns, new products/discounts, promotions, etc.), and allow Members to filter unwanted emails/information. It is kept confidential and used only within the ANTEPLİ BAKLAVA system.
